    2. What this policy covers

This policy explains how we collect and use personal data when you:

    • visit our website
    • submit a form (including from our adverts)
    • book or request a demo
    • contact us
    • opt in to receive marketing from Setterly.

    3. What data we collect

We may collect the following categories of personal data:

    • Identity and contact data - name, company name, job title, email address, phone number.
    • Enquiry and booking data - what you submit in forms, messages you send us, and details needed to arrange a demo.
    • Communication data - records of emails, calls, SMS and WhatsApp messages (including timestamps and delivery status).
    • Website usage data - IP address, device information, pages visited, and similar analytics data.
    • Marketing preferences - whether you opted in or opted out of marketing.

    4. How we collect your data

    We collect data when:

    • You submit an enquiry form on our website.
    • You submit a lead form via an advert (for example Facebook or Instagram) and choose to send us your details.

    5. How we use your data

    We use your data to:

    • Respond to your enquiry and provide information you requested.
    • Arrange and deliver demos and sales calls.
    • Contact you by SMS, phone and WhatsApp to schedule or confirm a demo and follow up on your request.
    • Improve our website and services.
    • Send you marketing if you have opted in.
    • Keep records for business operations, security, and legal compliance.

    6. Our lawful bases

Under the UK GDPR, we rely on the following lawful bases depending on the context:

    • Contract steps - where you request a demo or information and we need to contact you to take steps at your request before entering into a contract.
    • Legitimate interests - where it is reasonably expected for us to respond to your enquiry, manage our sales process, and improve our services (balanced against your rights).
    • Consent - where required for marketing communications and for non-essential cookies.
    • Legal obligation - where we must keep records or respond to lawful requests.

    7. How we contact you - SMS, phone, WhatsApp, and automated AI messaging

If you submit an enquiry (including from our adverts), you are asking us to contact you about Setterly.

We may contact you using one or more of the following channels:

    • SMS
    • Phone call
    • WhatsApp (where available)

We may use automation and AI-assisted messaging to respond quickly and to book you into a demo. This can include messages sent by an automated system and conversations handled by an AI agent. A human can review conversations and take over at any point.

We use this contact to respond to your request and to arrange a demo. If you opt in to marketing, we may also send separate marketing communications (see section 8).

    8. Marketing - your choices

We only send marketing from Setterly when you opt in (for example by ticking a marketing checkbox on a form).

You can opt out at any time by:

    • using the unsubscribe link in an email (if applicable)
    • replying STOP to an SMS (where provided)
    • telling us during a call, or
    • emailing hello@setterly.co.

If you opt out, we keep a record of your preference so we do not contact you for marketing again.

    9. Automated decision-making and profiling

We may use automation to route enquiries, send messages, and schedule demos. We do not use solely automated decision-making that produces legal or similarly significant effects on you.

    10. Cookies and analytics

We use cookies and similar technologies on our website. This includes:

    • Google Analytics (to understand website performance) - only after you accept non-essential cookies
    • Meta Pixel (to measure our ads) - only after you accept non-essential cookies
    • LeadConnector (to capture and manage enquiries and booking activity when you use our forms or booking calendar)

When you first visit, a cookie banner asks you to accept or reject non-essential cookies. Until you accept, Google Analytics runs in a cookieless, consent-denied mode and the Meta Pixel does not set cookies. Your choice is stored in your browser. You can change it at any time with the button below or by clearing this site's data in your browser.

    11. Who we share data with

We may share personal data with service providers who help us run our business, such as:

    • website hosting and infrastructure providers
    • analytics providers (for example Google Analytics)
    • CRM and workflow tools (including LeadConnector)
    • communications providers for email, SMS and WhatsApp delivery
    • professional advisers (legal, accounting) where needed

We only share what is necessary and we require appropriate safeguards and confidentiality.

    12. International transfers

Some suppliers may process data outside the UK. Where this happens, we use appropriate safeguards recognised by UK data protection law.

    13. Data retention

We keep personal data only as long as needed. Our standard retention periods are:

    • Enquiries and demo-related records - up to 24 months from last meaningful contact.
    • Marketing subscribers - until you opt out, after which we keep a suppression record.

    14. Security

We use technical and organisational measures designed to protect personal data, including access controls and security monitoring.

    15. Your rights

You have rights under UK GDPR, including the right to request access, correction, deletion, restriction, and to object to certain processing. You can also withdraw consent where we rely on consent.

    16. Complaints

If you are unhappy with how we use your data, you can contact us at hello@setterly.co. You also have the right to complain to the Information Commissioner's Office (ICO).

These messages may include but are not limited to: appointment reminders, booking confirmations, follow-up messages, promotional offers, service updates, marketing communications, surveys, and other business-related notifications.
