Texting compliance for lead reactivation

Texting old leads in the US: TCPA, A2P 10DLC and state rules explained

You can text people who inquired with your business, but US rules on consent, timing, frequency and number registration are strict. This guide explains them in plain English and shows how Setterly works with clients on each one.

It is general information, not legal advice. Check your own situation with counsel.

    • Consent: check what the original inquiry form or platform said about texting. Consent rules differ for marketing and informational messages.

    • Quiet hours: federal rules restrict telephone solicitations to 8am to 9pm recipient local time. Some states are stricter.

    • State rules: Florida, Oklahoma, Maryland and others limit hours to 8am to 8pm and messages to three per 24 hours on the same subject. Texas, Minnesota and Rhode Island start later.

    • Opt-outs: STOP must work instantly and be honored across every channel.

    • 10DLC: business texting from a standard 10-digit number needs A2P 10DLC brand and campaign registration, or carriers block it.

What times can you text leads?

Federal rules restrict telemarketing calls to between 8am and 9pm in the recipient's local time, and marketing texts are generally treated the same way (ActiveProspect). Several states go further. A sample, as summarized by ActiveProspect in September 2026:

    StatePermitted hoursOther limits
    Federal baseline8am to 9pm
Florida8am to 8pm3 per 24 hours (Postscript notes "regarding the same subject matter")
Oklahoma, Maryland8am to 8pm3 per 24 hours on the same subject
    Oregon8am to 8pmGenerally 3 solicitations in 24 hours
Alabama, Louisiana, Mississippi8am to 8pmNo Sundays or holidays
Texas9am to 9pm Mon to Sat, noon to 9pm Sun
    Minnesota9am to 9pm
    Rhode Island9am to 6pm weekdays, 9am to 5pm Sat
    Washington8am to 8pm

State laws change. Check a current tracker such as Tychron's state texting laws guide before a campaign, and send in the lead's local time zone, not yours.

    How should opt-outs be handled?

Every message should make it easy to stop, and STOP (and common variations such as "unsubscribe" or "no more texts") must be honored immediately. Opt-outs should carry across every number and channel your business uses, and be kept on file so the person is never contacted again by any campaign.

Setterly honors opt-outs straight away, stops the conversation and flags the contact back to you.

What is A2P 10DLC and do you need it?

A2P 10DLC is the carrier registration system for business texting from standard 10-digit US numbers. Your business (the brand) and your use case (the campaign) are registered and vetted, and unregistered traffic is blocked or filtered by carriers (JustCall). Registration carries one-off and monthly fees (BlueReacher).

For lead reactivation, the campaign description, sample messages and opt-in description need to match what you actually send. Setterly sends from a registered number in your business name.

How does Setterly handle compliance with clients?

Before a campaign starts we go through these points with you:

    • Lead source and consent: you confirm where each list came from and what the person agreed to. We leave out sources that don't fit.
    • Wording: you approve the messages. Every message identifies your business and makes it easy to opt out.
    • Timing: messages go out inside federal and state hours in the lead's local time, with state frequency limits respected.
    • Opt-outs: honored immediately and passed back to you.
    • Registration: messages are sent from a registered number in your business name.
    • Records: every conversation is logged and visible to you.

None of this replaces your own legal advice. If your business has had TCPA claims before, or you work in a heavily regulated area such as auto finance, involve counsel early.

What extra rules apply to dental, medical and coaching businesses?

Dental and medical practices. HIPAA governs how patient information is handled. Standard SMS is not inherently HIPAA compliant, and the California Dental Association advises signing a Business Associate Agreement with any vendor that handles patient information and keeping texts to the minimum necessary (CDA). We agree the setup with each practice before a campaign, and texts never include clinical details.

Coaching and money-making programs. Don't promise earnings. In January 2025 the FTC proposed extending its Business Opportunity Rule to money-making opportunities such as business coaching, requiring substantiation for earnings claims (FTC; proposed, not final). Setterly's messages ask about goals and book a call; they never make income claims.

    How much does Setterly cost?

You pay per booked appointment. There is no setup fee and no retainer. CRM integration is optional and carries a one-off fee, agreed with you before any work starts.

    Frequently asked questions

Can I text leads who inquired years ago?

Possibly, depending on the consent they gave, the source of the lead and any opt-outs since. Age alone is not the test. Check the original consent language and your state's rules, and ask counsel if unsure.

What are the TCPA quiet hours?

Federal rules restrict telemarketing to 8am to 9pm in the recipient's local time, and marketing texts are generally treated the same way. Some states are stricter: Florida, Oklahoma and Maryland end at 8pm, and Texas starts at 9am.

How many texts can I send per day?

Federal rules don't set a simple daily number, but Florida limits calls and texts to three in 24 hours on the same subject, and similar state laws exist. A careful campaign spaces messages out.

    Do I need A2P 10DLC registration?

If you text customers from a standard 10-digit business number, yes. Carriers block or filter unregistered business traffic.

Can I text leads I bought from Angi or Thumbtack?

It depends on the platform's terms and the consent language the homeowner agreed to. Read the platform terms and check with counsel before texting platform leads.
